Renting out your property? You might at some point down the road face a problem of a non-paying tenant. If the situation is not dealt with urgently and efficiently outstanding rentals will accumulate rapidly due to non-payment by the Tenant and you might face serious financial repercussions.

In terms of the PIE Act no person may be evicted from their home without a court order. The Court will only grant an eviction order if the Court is satisfied that all the requirements of Section 4 of the PIE Act have been complied with and that no valid defense has been raised by the unlawful occupier, and the Court is of the opinion that it is just and equitable to do so after considering all relevant circumstances. It is therefore important to comply with all the requirements of the PIE Act and to place all relevant circumstances before the Court when bringing an application for eviction.

It is always best to contact your lawyer when you need to evict non-paying tenants.

WHAT IS A CONTRACT?

A contract is a voluntary arrangement between two or more parties that is enforceable by law as a binding legal agreement. It is not advisable to draw up contracts yourself or rely on “off the shelf” forms readily available these days.

Each contract is different and unique and requires the services of an attorney. This will ensure that many future pitfalls and problems are avoided and that your rights and interests are protected at all times.
