Hard fought and bitter sweet victory!

Client’s friend was driving from Maritzburg to Kokstad in August 2021 and was involved in an accident in UMzimkhulu where a 5 year old child was knocked down and killed. The driver fled the scene leaving behind his friend and brother who were passengers in the vehicle.
Vehicle owner was informed and he went to the police station to try and assist the investigation and get his vehicle back, but he was dismissed and told to find the driver and bring him to the police station.

About 2 months later the owner returned to the police with information that the driver was in East London and that he needed the police to come with him so that he could point out the driver to the police, he was dismissed again and told to bring him to the police station.

We got involved in July 2023 and were shocked to learn that the police did not even begin to investigate the case, only one statement was in the docket and the last entry was that of the officer who opened the case. We were unfortunately met with so much hostility, arrogance and incompetence from the detectives commander, station commander and even the district detectives commander in Kokstad.

We worked on the docket and managed to file four statements from eyewitnesses and the suspect’s father. Suspect’s father lied to us and said he had not seen his son since the day of the incident two years ago. We had earlier gotten information that the suspect was back home and only ran away again when we called his father to arrange a meeting for his statement, but we did not confront the father about this because we wanted to return and arrest the suspect.

We took the docket to the prosecutors for decision and the police were instructed to release the vehicle and find the driver.
We offered to assist in finding the suspect since we had already put our informers in his area on high alert to call us if he is seen, but we were dismissed and the police insisted on confronting his father before releasing the vehicle to the owner (to confirm that we were not lying)- a move that will scare the suspect from ever coming home again.
It is clear that the family of the victim will never see justice for their loved one and it hurts because this was a very easy case for the police, but they just chose not to work on it at all.

***We have so much respect for the police, but in this case we really had to call them out, and we expressed our outrage with them personally as well.
