Liability for Subcontractors

When you hire a subcontractor, their workers can legally be treated as your employees — unless the subcontractor has paid all required insurance premiums. If they haven’t, you could end up footing the bill.

COIDA covers all employees who are working in South Africa, including foreign workers and part-time employees such as domestic workers and part-time workers, who are injured or contract diseases while on the job. (However, some categories of employees are excluded from the Act)

The Compensation for Occupational Injuries and Diseases Act, No 130 of 1993 (COIDA) provides for compensation for disablement caused by occupational injuries or diseases sustained or contracted by employees in the course of their employment, or for death resulting from such injuries or diseases. All employers are required to register with the Compensation Fund. Registration opens on 1 April 2026.
