Michigan courts continue to shape the boundaries of no-fault coverage, and the latest Supreme Court decision offers important clarification on the scope of the “taken unlawfully” exclusion under MCL 500.3113.

In 𝘚𝘸𝘰𝘰𝘱𝘦 𝘷. 𝘊𝘪𝘵𝘪𝘻𝘦𝘯𝘴 𝘐𝘯𝘴𝘶𝘳𝘢𝘯𝘤𝘦 𝘊𝘰𝘮𝘱𝘢𝘯𝘺 𝘰𝘧 𝘵𝘩𝘦 𝘔𝘪𝘥𝘸𝘦𝘴𝘵, the Court rejected the argument that unlawful operation of a vehicle alone is enough to bar PIP benefits. Instead, the analysis must focus on whether the vehicle itself was unlawfully taken.
