Eleven years ago, Jim Obergefell just wanted his name on his husband's death certificate.⁠

He and John Arthur had been together for over 20 years. When John was diagnosed with ALS, they chartered a medical plane to Maryland, the nearest state where their marriage would be legal, so John could take Jim's hand and say the words they'd wanted to say for so long. John died three months later. Ohio refused to recognize Jim as his surviving spouse. ⁠

So Jim sued.⁠

The court ruled 5–4 that the 14th Amendment's equal protection clause requires all states to recognize same-s*x marriages. Justice Anthony Kennedy wrote for the majority: "They ask for equal dignity in the eyes of the law." ⁠

That dignity is not guaranteed today.⁠
⁠
32 states still have constitutional or legislative bans on same-s*x marriage sitting on the books, dormant, but not gone. If Obergefell were overturned, they would become enforceable immediately. That means roughly 60% of LGBTQ+ adults in this country live in states where access to marriage equality would change overnight. Justice Clarence Thomas has already said the court should reconsider it.⁠
