Some people may not be aware of the rights for a process server when they serve a paper in a residential area, whether its involved in an HOA or not. If a process server is waiting in a residential area to serve an individual, they have the right to wait there. As long as the process server is legally parked on the street and not in a person's yard or driveway. It is a crime (Class C Misdemeanor) if you intentionally prevent the ex*****on of civil process (Section 38.16 of the Texas Penal Code).
