**USCIS UPDATE: Court Order Impacts Certain β€œHold” Policies

πŸ“Œ On June 12, 2026, USCIS issued an alert regarding a federal court order in Dorcas International Institute of Rhode Island v. USCIS.

βš–οΈ According to USCIS, the U.S. District Court for the District of Rhode Island entered a final judgment that set aside certain USCIS β€œhold” policies.

As a result, USCIS stated that the following policies must be treated as **without force or effect**:

πŸ“„ Policies Affected:

β€’ PM-602-0192
β€’ PM-602-0194
β€’ PA-2025-26

⏳ These policies were previously related to the handling or temporary holding of certain immigration benefit requests.

This update may affect some applicants whose cases were delayed or placed on hold under these policies.

πŸ”Ž However, each case is still reviewed based on its own facts, eligibility requirements, and USCIS procedures.

Applicants should avoid assuming that a pending case will be approved immediately. It is important to continue monitoring official USCIS updates and seek professional guidance if your case may be affected.

πŸ“’ Pacific Immigration will continue to follow this matter and provide updates when more information becomes available.

πŸ‡ΊπŸ‡Έ THINK U.S. CITIZENSHIP IS STILL YEARS AWAY? YOU MAY BE CLOSER THAN YOU THINK.

Many green card holders assume they must wait 5 years before applying for U.S. citizenship.

But if you are married to a U.S. citizen, living with your spouse, and meet all other eligibility requirements, you may be eligible to apply after 3 years as a permanent resident β€” not 5.

USCIS also allows eligible applicants to file Form N-400 up to 90 days before reaching the required residency period.

That means:

βœ… Married to a U.S. citizen: you may be able to file for around 2 years and 9 months
βœ… Other green card holders: generally around 4 years and 9 months**

Those two years can make a big difference.

Of course, every case is different. Continuous residence, physical presence, marital history, tax records, travel history, and other factors may affect eligibility.

πŸ‡ΊπŸ‡Έ FEDERAL JUDGE RULES AGAINST USCIS PAUSE AFFECTING IMMIGRATION CASES FROM 39 COUNTRIES

A federal judge in Rhode Island has ruled that certain USCIS policies pausing immigration benefit decisions for applicants from 39 designated countries were unlawful.

The pause had affected some pending immigration applications, including:

βœ” Green Card applications
βœ” Work authorization requests
βœ” Naturalization applications
βœ” Certain asylum-related cases

For many affected applicants, this meant waiting months without a final decision on their cases.

Following the court’s decision, USCIS may need to continue processing impacted applications according to existing immigration procedures.

πŸ“Œ Important reminder:

This ruling does not mean every case will be automatically approved.

Each immigration application will still be reviewed individually based on eligibility, documentation, background checks, and applicable immigration laws.

If your case has experienced delays, it is important to understand what may be affecting your specific situation.

πŸ‡ΊπŸ‡Έ **LIVING ABROAD WHILE SPONSORING YOUR FAMILY? HERE’S SOMETHING MANY PEOPLE MISS.**

Many U.S. citizens living overseas focus on meeting the income requirement for Form I-864 β€” but there is another important factor to understand: **U.S. domicile.**

For certain family-based immigration cases, sponsors may need to show that the U.S. is their main residence or that they have a clear plan to return and reestablish their life in the United States.

A strong case is not just about having documents β€” it’s about having the right documents prepared.

βœ… Understand your requirements
βœ… Review your situation early
βœ… Avoid unnecessary delays
