๐ How you design and conduct interviews can make the difference between winning or losing a failure-to-hire or failure-to-promote case. Employers that take a laissez-faire approach are far more likely to invite โ and lose โ a lawsuit than those who follow a strict, consistent plan with objective, job-related questions for every applicant.
โ๏ธ A recent court case highlights this. An employee who met the basic qualifications for promotion interviewed alongside two others. A trained panel used the same interview format, the same questions, and a point system covering interviews, experience, reviews, and assessments. Even though she later alleged discrimination, the court found the process fair and tossed out the claim because the scoring and treatment were consistent and objective.
