Can you have a “radar detector” in a commercial truck?

Based on FMCSA Regulation (392.71) ⁣
⁣
•Radar detectors; use and/or possession.⁣
⁣
(A) No driver shall use a radar detector in a commercial motor vehicle, or operate a commercial that is equipped with or contains any radar detector.⁣
⁣
(B) No motor carrier shall require or permit a driver to violate paragraph (A) of this section⁣
⁣
A common mistake I’ve seen in my years of service from drivers is.
Drivers assuming that if the radar detector is not functioning or disconnected, the regulation does not apply.⁣

The Federal Regulation does not differentiate the radar detector being in operation at the time or not. By simply being inside of the Commercial Motor Vehicle, the violations is occurring and can be cited on the DVER and end up affecting your CSA score.⁣

Some States, such as the State of Arizona. Have adopted the Federal Regulation violation and is a citable offense by the Arizona Courts.⁣
⁣
Remember, any Federal Regulation violation is consider a criminal offense, misdemeanor. Which would result in Criminal points on your driver license.⁣
