White House calls lawsuit trying to stop Trump's UFC fight 'obstructionist' President Donald Trump’s planned UFC fight on the White House South Lawn is facing a new legal challenge just days before the event is scheduled to take place.
John P. Fishwick Jr., owner of Fishwick & Associates PLC and former United States Attorney for the Western District of Virginia, breaks down a developing legal question.
In a settlement with President Trump this week, the Department of Justice set aside $1.7 billion for people who claim they were targeted for political reasons by DOJ prosecutions. The central question is whether the DOJ has the authority to do this.
Under the separation of powers, it is generally Congress that decides what funds are appropriated for this sort of thing. Legal challenges are likely to argue that the DOJ — and the President — are outside their lane in authorizing an appropriation of this size. One challenge has already been filed, and others are expected.
The Supreme Court has viewed presidential power broadly, but it has also said courts can review what agencies do. This case may ultimately be decided by the U.S. Supreme Court: can the DOJ set up this anti-weaponization fund without the approval of Congress?
