In cases with multiple tenants listed on a lease, confusion may arise regarding the designated payee for the security deposit refund upon termination. This situation commonly occurs in roommate arrangements or during divorces where both individuals are lease tenants.

Frequently, a roommate or spouse may request the security deposit to be issued solely in their name. However, according to Paragraph 10C of the Residential Lease Agreement (TXR 2001), the landlord is obligated to make the refund check payable to all tenants named in the lease. As all tenants are parties to the lease, they are collectively entitled to any security deposit refund.
