Deed & Public Record Errors: Errors in clerical work or filing may impact the deed or property survey, potentially resulting in unexpected financial burdens to rectify the situation.
Hidden Mortgages & Liens: Previous property owners might not have maintained precise financial records or kept up with their bills. Despite the fact that the past debts are not your responsibility, banks or other financial institutions can still place liens on your property for unpaid debts even after you have completed the sale.
Missing Heirs: When an individual passes away, the property they owned may be inherited by their heirs or those specified in their will. Nevertheless, there are instances where these heirs are unaccounted for or unknown at the time of death. Alternatively, family members may dispute the will to assert their own property rights. So You're Under Contract. Now What?
As Your Title Company, We Will:
Receive A “Title Order” From Your Realtor Or Lender: Your realtor or lender will submit a “Title Order,” and provide us with your fully executed Purchase and Sale Agreement. We will create a file and proceed by collecting contact information for all parties and assisting you to get logged into our secure portal, where all documentation and sensitive information will be sent and received.
Collect All Necessary Information & Documentation: We then begin our process by gathering all information and documentation, such as taxes, loan payoffs, surveys, fees, inspections, insurance, and legal papers. A title search is also initiated.
Conduct A Title Search & Examination: This involves searching public records to find documents such as deeds, mortgages, assessments, liens, wills, divorce settlements, and others that can impact a property's title. The title examination is a review of these documents, which helps verify the property's legal owner and any outstanding debts related to it.
Begin Document Preparation & Schedule The Closing: Working closely with your lender, if applicable, we will prepare the closing statements and send them to the appropriate parties for review. The closing statement will be provided in the days leading up to the closing, and will contain the dollar amount the buyer will bring to the closing table. We will also schedule the closing at this time.
Facilitate The Closing: At the closing table we will walk the buyer and seller through the documents, ensuring all questions are answered. Once all of the documents are signed, we will disburse proceeds and commissions to the appropriate parties.
Post Close Your File: After the closing, we will send payment to any previous lender and all parties who provided services during the closing. The transaction documents are then officially recorded, and title insurance policies are prepared and sent to both the new lender and to you. A copy of all documentation is then sent to the buyer and seller. Importantly, these steps occur without any additional actions required from the buyer or seller.
