Texas homeowners, please be aware that it is illegal for any contractor to make the offer “to wave or absorb” your homeowners required deductible. You will be approached by contractors that will offer this “discount” to earn your business. To fall for this sales tactic is a crime, insurance fraud.

When the insurance company audits the claim and contacts the contractor to provide proof of full payment. The contractor will not be able to fulfill that request. The insurance company will then contact the insured homeowner for proof of full payment. The homeowner will not be able to fulfill that request. The Homeowners insurance will then require the full deductible amount refunded immediately. The insurance investigator will determine whether to file insurance fraud charges against the insured and contractor.

The State of Texas statute is below:

GOODS OR SERVICES PAID FOR BY INSURANCE PROCEEDS: PAYMENT OF DEDUCTIBLE REQUIRED
Texas law requires a person insured under a property insurance policy to pay any deductible applicable to a claim made under the policy. It is a violation of Texas law for a seller of goods or services who reasonably expects to be paid wholly or partly from the proceeds of a property insurance claim to knowingly allow the insured person to fail to pay, or assist the insured person's failure to pay, the applicable insurance deductible. Sec. 27.02 of the Texas Business and Commerce Code

Hello DFW and Texas friends. Again, I was told by one of my hail damage customers, “roofers” are continuing to knock on doors offering to “wave” or “absorb” the insurance deductible. This is blatant felony level insurance fraud.

Do not fall for this, if and when your claim is audited, you and your contractor will be required prove the full amount of insurance company estimated repair cost was paid. If you cannot prove full payments were made, you can loose your homeowners coverage, required to pay back the deductible to the insurance company and possibly charged with insurance fraud.

Please verify my statement above with your insurance company. “Waving” or “absorbing” the deductable is a crime in the state of Texas.
