What are some things that can influence custody decisions?
In Arizona, custody decisions are based on the best interests of the child.
That can include factors such as each parent’s ability to provide stability, the child’s relationship with each parent, school and community connections, communication between parents, the child’s adjustment to home life, and any concerns related to safety or well-being.
Every family is different, which means custody is not a one-size-fits-all decision. The focus should always come back to the child’s needs, routines, emotional health, and long-term stability.

We speak to many parents who want to take their children out to have some fun during times when their family unit might be changing.
So, we thought we'd share some family-friendly summer activities in Phoenix that we hear our clients are taking advantage of, regardless of whether they are spending time with their children together as parents or apart. Here are a few ways to beat the heat and keep everyone smiling:

- Explore the Children’s Museum of Phoenix
- Check out the Arizona Science Center
- Spend time at the library for summer reading activities
- Plan a movie afternoon
- Try a simple craft or baking project at home
- Go for ice cream after dinner
- Let your child help plan one “summer memory” for the week
For co-parents, shared summer memories do not have to look the same in each home. What matters most is that children feel safe, included, and free to enjoy time with both parents.

Have custody questions?
It's a good rule of thumb not to make any assumptions before making a plan to move. If you are divorced, separated, or sharing custody, making the decision to move away with your child will involve more than packing boxes and choosing a new school.
In Arizona, relocating with children can raise important legal questions, especially if the move is out of state or more than 100 miles within the state. Depending on your custody order or parenting plan, advance notice or court involvement may be required.
Will every change require the court to get involved? Probably not. But parents should understand their rights, responsibilities, and options before making decisions that could affect parenting time, school routines, and their child's stability.

When parents are going through a separation or divorce, one of the biggest concerns is how the children will adjust.
In Arizona, custody is generally discussed in terms of legal decision-making and parenting time, and this is important, but it is also important to remember that every family’s situation is different. The court’s focus is the child’s best interests, including their emotional well-being, stability, relationships, home life, school life, and ability to maintain meaningful connections with both parents (when appropriate).
For parents, this can be a helpful shift in perspective. Your situation is already stressful, so it helps to remind yourself that it's not about "winning" but about creating a plan that helps your child or children feel supported and loved.

Not every divorce has to follow the same path.
For example, some couples find that the Summary Consent Process offers a more straightforward way to move ahead, especially when there is already general agreement on the bigger decisions.
That said, it’s not just agreeing with everything along the way; it's both parties being clear about the outcome they want and doing what they can together to get there.
Here are a few things to think about:
✔️ Are both people comfortable having open, honest conversations about finances and next steps?
✔️ Is there a clear understanding of assets, debts, and responsibilities?
✔️ Are both parties willing to work toward resolution without escalating conflict?
This is the process we help our clients work through, so the outcome is more efficient and less stressful.

During a recent Kedia Law team Lunch and Learn, we had the chance to hear from Samone Bollerud-Beitler, a divorce-certified real estate expert, who walked our team through how real estate is handled differently during a divorce.
One of the biggest takeaways was that selling a home in this context is not the same as a typical transaction. Samone shared the differences between a divorce realtor and a normal realtor, and the importance of financial factors such as equity division, refinancing, and court-related requirements.
Our team walked away with a lot of useful information. It was also a great reminder of how important it is to have the right professionals involved when going through major life transitions.

One question we hear often is: “If we agree on everything, do we still need to go through the court?”
The short answer is yes, but it is often simpler than you might think.
Even when both parties are in agreement, the court still needs to review and finalize the terms to make everything legally binding. That’s where the Summary Consent Process comes in.
Instead of going back and forth in court, the focus is on submitting your agreement for approval, which can make the quicker and less stressful. That said, it’s still important to make sure everything is clearly outlined and properly prepared before it’s finalized.
