A job offer is usually the beginning of an opportunity, not the end of one.

In November 2022, a deaf applicant was offered a delivery driver position with ALM Freight, an Amazon delivery service partner. She accepted the job and began the onboarding process through the staffing agency LMDmax Corp.

For her first day of orientation, the newly hired driver requested an American Sign Language (ASL) interpreter as a reasonable accommodation.

Instead, she received a text message stating that the company does not provide interpreters and would not move forward with her hiring.
The EEOC’s suit alleged that the company’s refusal of the accommodation and subsequent revoking of the job offer violated the federal Americans with Disabilities Act (ADA).
The case has now been resolved.

ALM Freight will pay $47,000 and LMDmax Corp. will pay $60,000, for a total of $107,000 in damages to the applicant.

As part of the settlement, both companies must also:
• Provide training on disability discrimination and reasonable accommodations
• Track and report accommodation requests to the EEOC
• Improve onboarding practices to ensure compliance with federal disability law
