PUBLIC AWAITS FINDINGS OF STATE INVESTIGATION

On October 22, 2021 the Odessa American reported that the Department of State and Health Services, on behalf of the Centers for Medicare Services, investigated a complaint based on the photo of an equipment bag over a child’s head and torso. Medical Center Hospital's CEO indicated a report from the DSHS should be issued in about 10 days.

Please note that as of the date of this publication, it has been well over 10 days without the report described in the OA; in other words, Medical Center Hospital has not disclosed whether there were any violations of patient safety standards discovered by the Texas DSHS’s Nurse Investigator.

Of particular concern is whether Medical Center Hospital received any Condition-level deficiencies.

A Condition-level deficiency is any deficiency of such character that substantially limits the provider’s or supplier’s capacity to furnish adequate care or which
adversely affects the health or safety of patients. (see 42 CFR §488.24)

In addition to potential Condition-level deficiencies, monetary enforcement actions may also be levied by the State. Constituents of the Ector County Hospital District should also be informed if there were any monetary enforcement actions for deficient care.
