Understanding NYC’s Pet Law:
What Every Property Owner & Tenant Should Know

At HSC Management, we know that navigating pet policies in NYC buildings can be complex. The NYC Pet Law, or “90-Day Pet Law,” provides important protections for tenants while outlining clear guidelines for landlords and co-op/condo boards.

What is the NYC 90-Day Pet Law?
This law allows tenants to keep a pet in their unit—even if their lease prohibits pets—if:
✅ The pet has been kept openly (not hidden).
✅ The landlord, agent, or building staff has known about the pet for at least three months but failed to enforce the no-pet rule.
✅ The building has at least three residential units and is in an applicable borough (co-ops and rentals in all five boroughs; condos only in Brooklyn, Queens, and Staten Island).
✅ The pet does not cause a nuisance, damage, or safety concerns.

What Pets Are Allowed?
Boards and landlords can regulate:
📌 Number of pets per unit
📌 Size or weight restrictions
📌 Breed restrictions (e.g., Pit Bulls, German Shepherds, Rottweilers, etc.)
📌 Exotic pets (such as reptiles, large birds, or large fish tanks that may cause property damage)

What About Service & Emotional Support Animals?
Service animals & emotional support animals (ESAs) are not considered pets and are protected under the NYC Human Rights Law and Fair Housing Act. Property owners: Be mindful that broad “no dogs” policies cannot apply to registered service animals or ESAs.

Landlords and boards may request documentation from a licensed health professional confirming:
✔️ The resident has a disability
✔️ The animal provides necessary support
However, they cannot ask for details about the specific disability.

📜 Clearly communicate pet policies & require acknowledgment in lease agreements.
📋 Regularly train staff on pet policies & assistance animal laws.
⚖️ Enforce rules consistently to avoid legal risks.
📄 Provide written warnings before escalating policy violations.
📝 Document all violations thoroughly.
🔄 Review policies regularly to stay compliant with changing laws.
