If you’ve been in a car accident, waiting weeks or months to get medical treatment could hurt your case.

Insurance companies look for gaps in treatment. Why? Because they often argue that if you were truly injured, you would have sought medical attention sooner. The longer the gap, the easier it becomes for them to question whether the crash actually caused your injuries.

But this isn’t just about a legal claim.

After a collision, your body releases adrenaline. That adrenaline can temporarily mask pain, and it’s not uncommon for symptoms like neck pain, back pain, headaches, or even signs of a concussion to develop hours—or days—later.

Getting evaluated promptly can help identify injuries that aren’t immediately obvious and create a medical record documenting your condition after the crash.

Every situation is different, and there may be valid reasons someone doesn’t seek immediate care. This post (like all posts) is for general educational purposes only and is not legal advice (because I’m not your lawyer).

The strongest claims often have one thing in common: they leave very little room for dispute.

✔️Clear liability makes it much harder to argue that someone else caused the crash or that you were partially at fault.

✔️Video footage can answer questions that would otherwise become a “he said, she said” dispute.

✔️Immediate medical treatment helps document your injuries and creates a timeline connecting those injuries to the crash.

✔️Independent witnesses can provide an unbiased account of what happened, often adding credibility when the parties disagree.

Every case is different, and no single piece of evidence guarantees a particular outcome. But generally speaking, the more objective evidence there is, the harder it becomes to dispute what really happened.

Having nothing to hide and looking like you have nothing to hide aren’t always the same thing.

In nearly every case, credibility matters.

Deleting messages or records, becoming overly defensive, or changing your story can raise unnecessary questions, even if your intentions were completely innocent.

The truth doesn’t need help. Let the facts speak for themselves.

Three things nursing homes hope you never find out:

1. Profits over people.
The vast majority of nurses, CNAs, and other frontline caregivers want to provide great care. But when corporate owners prioritize budgets over staffing and resources, both the staff and the residents are put in an impossible position.

2. Marketing doesn’t always tell the whole story.
Phrases like “we treat your loved one like family,” “24/7 nursing care,” or “one-on-one supervision” sound reassuring. But don’t rely on the brochure alone. Ask questions, visit the facility, and see whether the care being provided matches the promises being made.

3. Understaffing is often at the heart of the problem.
In many of the cases I handle, understaffing isn’t just one issue. It’s the issue. When there aren’t enough people to meet residents’ needs, call lights go unanswered, falls happen, pressure injuries develop, medications are delayed, and preventable harm becomes more likely.

The goal isn’t to scare families. It is to help them ask better questions, make informed decisions, and advocate for the people they love.

Choosing a nursing home is one of the hardest decisions many families will ever make, and it usually happens during one of the most stressful times in their lives.

When your loved one is in the hospital, it’s completely understandable to lean on the recommendations you’re given. The discharge team is there to help, and they’re often working to find facilities with available beds as quickly as possible.

But it’s important to remember that you still have a choice.

If time allows, do a little homework. Read inspection reports and reviews, visit the facility if you can, and compare more than one option before making a decision.

A little extra research today could make a big difference in the care your loved one receives tomorrow.

Admission day is stressful. Families are focused on getting their loved one settled, not reading 30+ pages of paperwork.

That’s exactly why arbitration agreements are so easy to miss.

These agreements can affect your legal rights if something happens to your loved one, including whether a dispute is decided by a jury or in private arbitration.

I’ve also seen agreements with language that favors the nursing home, including provisions that attempt to limit a family’s recovery.

Take the time to read every page carefully.

If you come across an arbitration agreement, consider opting out.

The paperwork you sign on day one can have consequences long after admission.

This is what nursing homes DON’T want you to know….

Nursing homes don’t schedule tours during business hours by accident.

Touring during the day often means you’ll see the facility when administrators are present, staffing is at its highest, activities are taking place, and everything is running as expected.

That doesn’t necessarily reflect what evenings, nights, weekends, or holidays look like.

If you’re choosing a nursing home for someone you love, visit more than once—and if possible, visit at different times of the day. You may notice things you wouldn’t see otherwise.

In September 2020, Attorney Kristen's grandpa passed away after a rehab facility failed to care for him.

5 months later, she got a job representing people like him.

Her grandpa helped raise her. They were close in a way that's hard to put into words. In 2020, after his second stroke, he ended up at a rehab facility in Indiana. He didn't get great care. He was discharged, sent home, put on hospice, and passed away that September.

Early 2021, an opportunity came up to join a plaintiff's firm in Wisconsin on their nursing home litigation team.

Kristen almost said no.

When she was in law school, she'd ruled out family law for the same reason — too close to home. She'd seen enough of that world growing up. She didn't want to spend her career reliving it through other people's cases.

This felt the same.

But something was different this time. Instead of feeling like she'd be reliving it, it felt like she'd finally be doing something about it.

So Kristen took the job. And she never looked back.

Now she runs her own firm, Lojewski Injury Law. Nursing home abuse and neglect is the bulk of what she does. And every time an insurance company tries to minimize a case because someone was 90 or 95 years old, she thinks about her grandpa.

They took their last moments from them. That's where her head goes — not to the diminished value the defense wants to assign, but to what was actually stolen.

She didn't plan for her practice to be built around something so personal. But the cases that find you are sometimes the ones you were always meant to take.
