The Employee Retirement Income Security Act (ERISA) imposes a fiduciary duty of prudence on those managing employee benefit plans. This duty requires fiduciaries to act with care, skill, and diligence. But what does that look like in practice? ERISA expert Jason Kotlyarov, an attorney at Kutak Rock LLP, provides much needed clarity on this topic.

Your union holds sensitive member data that can't afford to disappear. And a backup you've never tested is a backup you can't trust.
The Department of Labor's Cybersecurity Best Practices specifically calls out Business Continuity & Disaster Recovery as a core standard for unions managing plan-related data. That means not just saving copies of your data, but verifying you can restore it when it counts.
✅ Follow the Cybersecurity and Infrastructure Security Agency's (CISA) 3-2-1 rule:
Keep 3 copies of your data, on 2 different storage types, with 1 stored offsite (or in the cloud).
✅ Schedule a recovery drill — at least quarterly — to confirm your backups actually work.
✅ Document your recovery process so any staff member can execute it under pressure.
True cybersecurity is an ongoing commitment, not a one-time achievement.

Your union's financial data is a prime target for cybercriminals, but with an educated, proactive effort, you can protect your union and its members from cyberattack. Monitoring for unauthorized access to financial systems is a big step. Here are some quick tips in that direction:
✅ Implement multi-factor authentication (MFA)
✅ Monitor user activity logs for unusual behavior
✅ Review access permissions regularly and remove outdated access
✅ Set up real-time alerts for suspicious activity like large transfers or unexpected login locations
✅ Ensure only authorized personnel have access to sensitive financial systems
True cybersecurity is an ongoing commitment, not a one-time achievement.

In his article for CyberSecure for Local Unions magazine, "AI on the Shop Floor: Security Risks You Can't Ignore," Jerrard Gaertner writes that "AI is transforming union workplaces, handling sensitive employee data often without proper oversight. While AI offers efficiency gains, legal risks are mounting. Proper controls are fiduciary obligations."

Union members face unique cybersecurity challenges when working in the field. The Department of Labor emphasizes that organizations must implement strong cybersecurity programs to protect sensitive information, particularly for those working outside traditional office environments. Implementing a well-defined mobile device policy is an integral part of your cybersecurity plan. 🤳
Your mobile device policy should include:
✅ Multi-factor authentication for accessing union systems from external networks
✅ Encryption requirements for sensitive data both in transit and at rest
✅ Clear protocols for reporting lost or stolen devices immediately
✅ Public Wi-Fi guidelines to prevent unauthorized data interception
✅ Annual cybersecurity training to help employees recognize attack vectors and respond to threats

Over 90% of cyberattacks begin with a phishing email. Teaching your team and members how to recognize phishing is one of the most effective ways to strengthen your union's cybersecurity.
Build your team's phishing recognition skills:
✓ Train staff and members not to open suspicious email attachments or click on suspicious links.
✓ Provide comprehensive initial training covering how to spot suspicious emails, verify sender identities, and report potential threats
✓ Make training ongoing — consistent reinforcement builds strong security habits
Your staff are a valuable asset in protecting member information. Every investment in phishing awareness training strengthens your union's overall security posture.
True cybersecurity is an ongoing commitment, not a one-time achievement.
