EB-5 grandfathering clause: if you file your I-526E petition before September 30, 2026, future changes to the program may not affect your case.

Aarushi Gupta of Donoso and Partners LLC explains what this means in practice. Whatever the program becomes after September 30, 2026, applicants who filed before that date will be governed by the existing laws for the full journey. Between 2026 and 2027 there will be deliberation on the program's future. Those who filed in time do not need to wait for that outcome.
