The “grandfathering” deadline is September 30, 2026. This cutoff date allows applicants to submit an EB-5 petition to USCIS to lock in their current investment requirements before the program ends in 2027.

Jennifer Hermansky, the EB-5 Committee chair for AILA and an EB-5 shareholder at Greenberg Traurig, LLP, said that the attorneys' association is asking USCIS to process the pending adjustment of status (AOS) applications for those with approved EB-5 petitions to minimize visa waste for the fiscal year.
