Earlier this month, multiple federal judges in West Virginia ordered four immigrants detained by Immigration and Customs Enforcement agents in January, to be released from jails throughout the state. U.S. District Judge Thomas Johnston, U.S. District Judge Robert C. Chambers and U.S. District Judge Joseph R. Goodwin ruled in separate cases that their detentions were unconstitutional.

ICE reported 650 immigrants had been arrested over two weeks in January. Fifteen of those people have asked judges to order their release, arguing they are unconstitutionally detained.

In one such case, Johnston wrote in his order that due process applies to all people on American soil, regardless of immigration status.

“Today, immigrants are being detained without due process. Tomorrow, under the Government’s interpretation of the law, American citizens could be subject to the same treatment. This Court will not allow such an unraveling of the Constitution,” Johnston wrote.
