Houston is debating a major change: a proposed Right-to-Air-Conditioning ordinance that would require landlords to provide and maintain refrigerated cooling in rental units inside city limits. We’re watching this closely because it matters for buyers, sellers, landlords, and investors across Texas.
Here’s what we’re telling clients:
• This proposal isn’t law yet—it's been introduced and is pending committee review. Until adopted, current landlord–tenant rules still apply.
• It wouldn’t demand central HVAC—window units or approved portable refrigerated systems could comply.
• The number of Houston rentals without AC is smaller than headlines imply; most modern homes already have cooling, but older apartments, manufactured housing, and long-held affordable rentals could be affected.
• Investors and landlords should inventory HVAC age, budget for replacements, and review electrical capacity now. Buyers should add HVAC condition to due diligence. Renters should document lease promises and report unsafe conditions in writing.
