On July 2, the Fifth Circuit decided Sosnava Rodriguez v. Ortega, a major win for immigrant families in Texas, Louisiana, and Mississippi.

πŸ“Œ What happened
Since 2025, the government has been detaining people who entered without papers and holding them with no bond, even those who have lived here for many years. The court said that cannot continue.

βš–οΈ The new rule
The government can detain someone for up to 90 days. After that, it must provide a bond hearing and prove a real reason to keep them held, like flight risk or danger. Being undocumented is not enough on its own.

βœ… Who this helps
Long-term residents, parents of U.S. citizen children, and people with no criminal record now have a stronger path to fight for release.

πŸ”Ί The limits
It does not stop a removal case, does not cover criminal detention under a separate law, and could still be narrowed on appeal. A related case is pending at the Supreme Court.

Today the Supreme Court answered a question that has weighed on immigrant families for more than a year: are children born in the United States still citizens, even when their parents are undocumented or here on a temporary visa?
The answer is yes.

In Trump v. Barbara, decided June 30, 2026, the Court struck down the executive order that tried to limit birthright citizenship and affirmed that any child born on U.S. soil is a citizen at birth, protected by the 14th Amendment.
The Court struck down the order by a vote of 6 to 3, and ruled on the underlying constitutional question by a vote of 5 to 4. The constitutional ruling is now controlling law, which means this protection cannot be undone by another executive order.
