How To Prepare

The parties should attempt to bring any documents concerning the issues that might be discussed at the mediation. They should also have authority to make settlement decisions or have someone available who does. Having settlement authority and appropriate documents can speed up the process, increase the likelihood of success and lead to a more equitable resolution.

Position Papers

In more complex cases, Mr. Bennett welcomes mediation briefs (position papers) prior to the in-person session. The briefs outline issues as perceived by the parties and are useful in saving time and helping the mediator to thoughtfully prepare. The briefs range from the very informal to formal and may be shared with the opposing side(s) or given to the mediator for “his eyes only” depending on the parties’ preference.

Philosophy

Mr. Bennett uses a variety of approaches to mediation as each case presents its own unique challenges and opportunities. He utilizes techniques to help parties focus on priorities and find common ground. He is especially skilled at quickly getting to the root of the problem and typically provides his assessment of the issues from the standpoint of an experienced third-party neutral. In his experience, he finds the vast majority of disputes can be settled through mediation with the help and patience of a skilled professional mediator.
