The U.S. Supreme Court has ruled 7-2 in favor of Bayer in a major Roundup case, finding that federal pesticide labeling law preempts certain state failure-to-warn claims.
At the center of the case was Missouri resident John Durnell, who said decades of Roundup use caused his non-Hodgkin lymphoma. The Court held that Bayer could not be required under state law to add a cancer warning when the EPA had not required one under federal law.
This decision could have a major impact on thousands of pending Roundup cases and may also influence future product liability claims involving federally regulated warning labels.
Bayer called the ruling an important step toward regulatory clarity, while critics argued it limits legal options for injured individuals. The company has also proposed a $7.25 billion settlement to help resolve many remaining claims.
