Colorado conforms to the Military Spouses Residency Relief Act. For tax years beginning on or after January 1, 2009, wages and tips of qualifying nonresident spouses are not taxable in Colorado. A qualifying spouse must have moved to Colorado from another state, be in Colorado solely to accompany their AD spouse, and have the same state of residency as the home of record as the servicemember. A qualifying spouse must submit a DR 1059 to their employer every year. This form can be found on the Colorado Department of Revenue website.
