The police officer who was in charge of bringing charges against the driver who ran over and killed my mom, forgot to check the box that says “resulted in death”. As a result of this discrepancy, that same driver decided to plead guilty to careless driving. There was nothing else that could be done since you can’t bring a second case against someone for the same event. This is an example of what can happen when the criminal justice system is outside the control of the family.
To succeed in a civil case, you have to demonstrate that it’s more likely true than not true that the other person caused the injury and the injuries you sustained were caused by that same injury as well. However, to succeed in a criminal case, it must be proven beyond a reasonable doubt – otherwise known as the Burden of Proof law.
