According to the lawsuit, the delivery took a tragic turn as the baby became stuck during labor. Allegedly, Dr. St. Julian failed to promptly seek assistance and instead exerted an excessive amount of force in an attempt to deliver the baby naturally. The prolonged delay in taking decisive action resulted in catastrophic consequences.
It took roughly three hours for Dr. St. Julian to finally opt for a cesarean section, by which time the baby's heartbeat had ceased. The surgical procedure removed the baby's legs and body, while the head was delivered through vaginal means. The lawsuit emphasizes that the parents' plea for a C-section, which could have potentially saved the baby's life, was denied.
The tragic incident has raised concerns about racial disparities in maternal and infant mortality rates, as the parents' attorneys highlight the higher risks faced by Black women during childbirth.
The lawsuit also accuses Southern Regional Medical Center staff of attempting to conceal the grim reality of the situation by discouraging an autopsy, pushing for cremation, and manipulating the baby's body to create a deceptive appearance.
The grieving parents seek justice for their baby's untimely death, alleging gross negligence, fraud, and intentional infliction of emotional distress. The lawsuit targets both Dr. Tracey St. Julian and Southern Regional Medical Center and calls for unspecified punitive damages.
