USCIS Issues Policy Guidance on Deference to Previous Decisions 04/28/2021

A new immigration policy could make it easier for nonimmigrant workers to extend their status. Legally speaking, the policy isn鈥檛 new. USCIS previously gave deference to prior decisions when deciding an extension request where the case involved the same parties and facts. Adjudicators would analyze an extension of status application further only if the matter involved material changes or facts. This policy, however, was rescinded in 2017 under the Trump administration. Adjudicators began requesting evidence or rehashing issues that had already been resolved in prior applications. The unnecessary delay put everything at a standstill for employers, workers and their families.

USCIS shifted its position once again for the better, returning to a more streamlined policy of giving deference to prior determinations. This will cause less delay and more certainty in extension requests. It is a step in the right direction.
