Being listed on your child’s birth certificate in Georgia does NOT automatically give a father legal rights.

Under Georgia law, if parents are not married, the mother has sole legal custody at birth. Even if your name is on the birth certificate, a father must file a legitimation action to establish legal parental rights.

Through a legitimation case, the court can:
• Establish you as the legal father
• Determine custody and parenting time
• Give you the right to participate in major decisions for your child
• Address child support

Without legitimation, a father may not have enforceable custody or visitation rights.
