An Indigenous tribe is suing to stop the planned removal of 90% of a wild horse herd.

The Utu Utu Gwaitu Paiute Tribe has filed a federal lawsuit seeking to stop the planned removal of 624 wild horses from the Montgomery Pass Wild Horse Territory, near the California-Nevada border.

The removal, scheduled to begin on July 8, would eliminate about 90% of the herd.

The U.S. Forest Service says the area can sustainably support only 130 to 238 horses and argues the current population is damaging habitat and creating safety concerns.

The tribe strongly disagrees.

It argues the horses are part of its cultural heritage and says federal agencies approved the removal without completing legally required consultation with the tribe or fully evaluating potential impacts on sacred sites and cultural resources.

The lawsuit also challenges the data used to justify the roundup. According to the tribe, the most recent horse census was conducted in 2024 and does not account for known deaths that occurred after a severe winter in 2023.

The tribe is asking the court to issue a temporary restraining order that would halt the operation while the case moves forward.

Wild horse management has long been one of the most controversial issues on public lands in the western United States.

Supporters of removals argue that horse populations can grow rapidly, placing pressure on vegetation, water sources, and other wildlife when numbers exceed what the landscape can support.

Critics argue that large-scale roundups can disrupt herds, threaten culturally important animals, and rely on outdated population estimates.

The court's decision could determine whether the planned removal proceeds as scheduled or is delayed while the legal challenge is heard.
