Yesterday a woman named Jane called me to ask about divorce coaching. She was hoping to represent herself in her divorce, go pro se, but had a number of questions that she couldn’t answer by googling them. She said that her husband was an attorney and he had filed for divorce two years ago. He told her that if she tried to get child support, that would make the divorce “contested” and the court would MAKE them hire an attorney for their 3 year old son.
This is not accurate, and divorce law advice coming from your spouse is not reliable. Getting attorneys appointed to represent children is rare. It should not be necessary unless one parent is claiming that the other parent is unfit, i.e. should not have any custody or visitation, or should only be allowed supervised visitation, or if one parent is trying to take custody away from the other. The court is not in a rush to appoint attorneys to kids, because it’s just sad, nobody wants that. It’s not surprising that one spouse would tell another this, however, to discourage them from getting the issue before the court.

Subdivision two of Section 39 of the Banking Law is hereby modified to provide that it shall be deemed an unsafe and unsound business practice if, in response to the COVID-19 pandemic, any bank which is subject to the jurisdiction of the Department shall not grant a forbearance to any person or business who has a financial hardship as a result of the COVID-19 pandemic for a period of ninety days.
