🇺🇸 DOL to Require English Proficiency for Foreign Truck Drivers

The U.S. Department of Labor (DOL) will soon require companies hiring foreign commercial truck drivers to include English-language proficiency (ELP) requirements in all labor certification applications and job orders.

📌 Key points:
• Foreign CMV drivers must be able to speak, read, and understand English.
• The rule takes effect around June 14, 2026.
• Companies that fail to include ELP requirements will receive a “Notice of Deficiency.”
• Labor certification processing may be paused until violations are corrected.
• The policy aligns with FMCSA federal safety regulations.

Acting Labor Secretary Keith Sonderling stated that enforcing English proficiency requirements is essential for highway safety and regulatory compliance.

The Department of Labor also confirmed that:
✅ FMCSA remains responsible for ELP testing and enforcement.
✅ The State Department has resumed issuing visas for foreign truck drivers.

🚨 Обновление по очистке реестра ELD от FMCSA 🚨

FMCSA аннулировала регистрацию еще трех электронных логбуков (ELD):

❌ Safe ELD (iOS и Android)
❌ MyLogs ELD

По данным FMCSA, данные устройства не соответствуют минимальным федеральным требованиям согласно 49 CFR Part 395 Appendix A.

📌 Важно:
• С января 2025 года FMCSA исключила уже 67 несоответствующих ELD.
• У перевозчиков есть до 60 дней на замену устройств.
• Водители должны немедленно перейти на бумажные логи или другое соответствующее ПО.
• Крайний срок замены устройств — 7 июля.

⚠️ До 7 июля:
Инспекторам рекомендуется НЕ выписывать штрафы за:
• Отсутствие логбука (395.8(a)(1))
• Использование незарегистрированного ELD (395.22(a))

⚠️ После 7 июля:
Перевозчики и водители, продолжающие использовать данные устройства, будут считаться работающими без соответствующего ELD и могут получить штрафы.

📌FMCSA также заявила, что устройства могут быть возвращены в реестр после устранения нарушений, однако перевозчикам настоятельно рекомендуется заменить их уже сейчас во избежание проблем.
