California AB 455: 2026 Smoking Disclosure Requirements
• Effective Date: January 1, 2026.
• Requirement: Sellers of residential properties and landlords with long-term tenants must disclose in writing any actual knowledge of:
1. To***co or ni****ne residue (thirdhand smoke).
2. Any history of smoking or va**ng on the premises by residents/occupants.
• Applies To: All transactions requiring a Transfer Disclosure Statement (TDS), including the sale of 1-4 unit residential properties and leases over one year.
• Guidance for Realtors: You must ask sellers direct questions about prior smoking/va**ng and document their responses. Cosmetic improvements do not remove the disclosure obligation.
