Rodriguez-McCloskey successfully defeated an appeal before the New York Appellate Division, Second Department, preserving an arbitration award on behalf of Concrete Structures, Inc.

The dispute arose from the termination of construction subcontracts during the COVID-19 pandemic. Following a nine-day arbitration hearing, the panel determined that the subcontractor had been improperly terminated.

On appeal, the defendant sought to vacate the award under the Federal Arbitration Act. The Second Department rejected those arguments and affirmed the judgment in full. With the successful defense of this appeal, the award for our client now exceeds $1.7 million, with interest continuing to accrue at 9% on the bond.

This decision reinforces the deference afforded to properly conducted arbitration proceedings and the importance of thorough preparation at every stage of a dispute.
