Re: Comments in Opposition to HUD’s Proposed Rulemaking- “Equal Access to Housing in JUD Programs Revisions (Docket No. Fr-6518-P-01)
To Whom It May Concern,
I am writing on behalf of the Harborview Residents Committee Inc. to strongly oppose the proposed changes to the Equal Access Rule issued by the US Department of Housing and Urban Development (HUD). This proposal threatens to eliminate vital Equal Access Rule protections for the diverse families within our community. As an organization dedicated to supporting stable, thriving local households, we know that strong communities depend entirely on secure housing for all family units, without exception.
The Department’s proposal to replace gender identity protections with an “immutable biological sex” requirement directly targets the safety of diverse family structures. By undermining the Equal Access Rule, this policy empowers federally funded housing providers and shelters to separate, displace, or deny assistance to LGBTQ+ parents and their children. Within our community, these protections are what ensures our transgender, non-binary, and same-sex parents are recognized as legitimate family units and afforded dignity of stable shelter. No family should ever be forced to choose between hiding who they are and having a safe place to call home.
The nationwide housing crisis demands solutions that increase stability, not discriminatory rules that actively worsen homelessness. Research consistently shows that LGBTQ+ households face significantly higher rates of housing discrimination and displacement. Stripping away these federal protections will disrupt children's lives, separate supportive partners, and expose vulnerable families to severe financial and emotional trauma.
A family is defined by love, mutual support, and shared lives- not by rigid biological definitions used to restrict access to basic human needs. The Harborview Residents Committee, Inc. firmly believes that every family, regardless of sexual orientation or gender identity of its members, deserves equal protection under the law and a safe environment to raise their children.
Some things that residents have said about this proposal:
“Some of my friends are gay or transgender. It took a lot for them to come out and tell their family. This proposal would stop people from being who they are for fear of losing housing.”
“If a person can pass a CORI then why should we be worried about what their gender identity is or their sexual preference.”
“Individuals who identify as LQBTQ+ are at higher risk for depression and suicidality. This would increase that.”
“Everyone deserves to feel safe in their place of living. No one should have to hide who they are.”
“First, they tried kicking out mixed status families, now LGBTQ+, what population is next? Those with mental illness? Those are not Christian? Those with autism? Where does it stop.”
We strongly urge HUD to withdraw this harmful proposal immediately and uphold the full scope of existing Equal Access protections.
