Just recently we learned that Ohio law regarding post-nuptial agreements has changed, which we expect will streamline the process for Ohio clients going forward.

When a pension plan is terminated, the employees are immediately 100% vested and are eligible for a lump sum distribution. However, a company may freeze a plan for years before deciding to terminate it. Some plans that are critically underfunded may be transferred to the PBGC (Pension Benefit Guarantee Corporation). In both of these situations, the In Marriage QDRO® should be considered.

An in-service distribution can be a valuable tool for planning a client’s financial situation. However, there are limitations to in-service distributions.

What if...

-Your client’s plan does not allow in-service distributions (30% of plans do not)?
-Your client is under 59 ½ years old and wants to liquidate the funds without incurring the 10% withdrawal fee?
-Your client wants to access more than the plan's amount limitations?

In these cases, we suggest that you consider the In Marriage QDRO® (IMQ).

-An IMQ can be performed with any qualified retirement plan.
-All married clients, at any age, can use the IMQ to liquidate funds without the 10% penalty.
-An IMQ can be used to transfer all vested interest in a 401k (not just the employee contributions).
