What Is a Bank Levy? How to Protect Your Assets from IRS Collection
At Alpha Tax Relief Specialists, we understand the stress of dealing with unpaid debts, especially those owed to the IRS. One of the most severe collection actions the IRS can take is a bank levy, where your bank account is frozen, and funds are seized to cover unpaid taxes. This guide explains what a bank levy is, how it works, and actionable steps you can take to protect your assets.
________________________________________
What Is a Bank Levy?
A bank levy is a legal mechanism that allows creditors, such as the IRS, to withdraw money directly from your bank account to satisfy an outstanding debt. When the IRS initiates a levy, your bank is required to freeze your funds for 21 days before transferring them to the IRS if the debt remains unresolved.
This 21-day period is a critical window to:
โ€ข Dispute the levy.
Negotiate a payment plan.
Work with professionals to safeguard your finances.
________________________________________
How Does a Bank Levy Work?
Hereโ€™s the typical process for an IRS bank levy:
1. Levy Notice Sent to Bank: The IRS notifies your bank of the levy.
2. Account Freeze: The bank freezes your funds for 21 days, making them inaccessible to you.
3. Fund Transfer: If no action is taken, the bank sends the frozen funds to the IRS.
During the freeze period, you have the chance to take steps to contest or resolve the levy. Acting quickly during this time can help you avoid losing your funds.
________________________________________
What Triggers a Bank Levy?
Common reasons for an IRS bank levy include:
โ€ข Unpaid Federal Taxes: The most frequent cause of IRS levies.
Ignored IRS Notices: The IRS typically issues multiple warnings before taking this step.
Other Debts: While less common, unpaid child support or federal student loans can also trigger levies (usually requiring a court order).
Understanding these triggers allows you to take proactive measures to prevent a levy from being issued.
________________________________________
Your Rights and Options During a Bank Levy
When facing a bank levy, itโ€™s essential to know your rights and explore available options:
โ€ข Right to Contest: Dispute the levy if it was issued in error or claim exemptions for protected funds.
Negotiate with the IRS: Options like payment plans or offers in compromise can help stop the levy and resolve the debt.
Hardship Relief: If the levy creates significant financial hardship, you may qualify for relief.
By taking prompt action during the freeze period, you may be able to avoid losing your funds and resolve the issue effectively.
________________________________________
How to Prevent a Bank Levy
The best way to protect your finances is to stay ahead of potential issues. Hereโ€™s how:
1. Stay Current on Tax Payments: Filing and paying taxes on time reduces the risk of collection actions.
2. Set Up a Payment Plan: If you owe back taxes, arranging a payment plan with the IRS can prevent a levy.
3. Seek Professional Guidance: Financial planning with tax professionals can help you address tax obligations before they escalate.
Proactive steps not only prevent levies but also provide peace of mind about your financial future.

FAQs
Q: How long does a bank levy last?
A: The IRS imposes a 21-day freeze period during which the funds are inaccessible. If the debt isnโ€™t resolved, the funds are transferred after this period.
Q: Can a bank levy be reversed?
A: Yes, it can be reversed by disputing the levy, arranging a payment plan, or claiming a hardship exemption.
Q: What happens if I ignore a levy notice?
A: Ignoring the notice can result in the permanent loss of funds from your account. Acting quickly during the freeze period is crucial.
Let Alpha Tax Relief Specialists help you navigate these challenges and secure your financial stability.

Leaving your IRA to your heirs is ๐ง๐จ๐ญ good tax planning.

Retirees are making a ๐˜ฉ๐˜ถ๐˜จ๐˜ฆ ๐˜ฎ๐˜ช๐˜ด๐˜ต๐˜ข๐˜ฌ๐˜ฆ by leaving their traditional IRA or qualified plan to their spouse or children. However, the owner of an IRA or qualified plan can ๐ญ๐š๐ค๐ž ๐š๐œ๐ญ๐ข๐จ๐ง to increase the value of the inheritance by ๐ซ๐ž๐๐ฎ๐œ๐ข๐ง๐  ๐ญ๐š๐ฑ๐ž๐ฌ. Most inherited assets are received income tax-free, and the heir receives an increase in tax basis to the current fair market value. The beneficiary of a traditional IRA or other retirement account pays taxes on the distribution from the IRA or retirement account just as the previous owner would have. The ๐›๐ž๐ง๐ž๐Ÿ๐ข๐œ๐ข๐š๐ซ๐ฒ ๐จ๐ง๐ฅ๐ฒ ๐ข๐ง๐ก๐ž๐ซ๐ข๐ญ๐ฌ ๐ญ๐ก๐ž ๐š๐Ÿ๐ญ๐ž๐ซ-๐ญ๐š๐ฑ ๐ฏ๐š๐ฅ๐ฎ๐ž of a traditional retirement account or individual retirement account.

In 2019, the ๐’๐„๐‚๐”๐‘๐„ ๐€๐œ๐ญ mandated that most beneficiaries of traditional IRAs and retirement plans must distribute the entire IRA within 10 years, known as the ๐Ÿ๐ŸŽ-๐ฒ๐ž๐š๐ซ ๐ซ๐ฎ๐ฅ๐ž.

The forced distributions from an inherited traditional IRA are ๐ฅ๐ข๐ค๐ž๐ฅ๐ฒ ๐ญ๐จ ๐ข๐ง๐œ๐ซ๐ž๐š๐ฌ๐ž ๐ญ๐ก๐ž ๐›๐ž๐ง๐ž๐Ÿ๐ข๐œ๐ข๐š๐ซ๐ฒ'๐ฌ ๐š๐๐ฃ๐ฎ๐ฌ๐ญ๐ž๐ ๐ ๐ซ๐จ๐ฌ๐ฌ ๐ข๐ง๐œ๐จ๐ฆ๐ž enough to ๐ฉ๐ฎ๐ฌ๐ก ๐ญ๐ก๐ž๐ฆ ๐ข๐ง๐ญ๐จ ๐š ๐ก๐ข๐ ๐ก๐ž๐ซ ๐ข๐ง๐œ๐จ๐ฆ๐ž ๐ญ๐š๐ฑ ๐›๐ซ๐š๐œ๐ค๐ž๐ญ. The distributions might also trigger or increase one or more stealth taxes, such as the Medicare premium surtax or income tax on Social Security benefits.

Taxpayers who are taking forced distributions from significant inherited IRAs are

IRA account owners who view their IRAs primarily as reserve accounts to be left to their heirs should By using one or more of these strategies, you can pay the income taxes on the traditional IRA, which is essentially a tax-free gift to the heirs, ๐˜ฎ๐˜ข๐˜น๐˜ช๐˜ฎ๐˜ช๐˜ป๐˜ช๐˜ฏ๐˜จ ๐˜ต๐˜ฉ๐˜ฆ ๐˜ง๐˜ถ๐˜ญ๐˜ญ ๐˜ฃ๐˜ฆ๐˜ฏ๐˜ฆ๐˜ง๐˜ช๐˜ต of the inheritance rather than just the after-tax amount. Furthermore, this is likely to reduce the taxes paid.

A ๐˜ค๐˜ฐ๐˜ฎ๐˜ฎ๐˜ฐ๐˜ฏ ๐˜ด๐˜ต๐˜ณ๐˜ข๐˜ต๐˜ฆ๐˜จ๐˜บ is to convert ๐š ๐ฉ๐จ๐ซ๐ญ๐ข๐จ๐ง ๐จ๐Ÿ ๐ฒ๐จ๐ฎ๐ซ ๐ญ๐ซ๐š๐๐ข๐ญ๐ข๐จ๐ง๐š๐ฅ ๐ˆ๐‘๐€ ๐ญ๐จ ๐š ๐‘๐จ๐ญ๐ก ๐ˆ๐‘๐€. You include the converted amount in your gross income and pay income taxes on it.

Another strategy is to Pay the taxes on the distribution and You can invest in this account to earn primarily long-term capital gains or other tax-favored income.

Another strategy is to This flexible plan can be structured to meet your goals and needs. You can withdraw from a traditional IRA in a lump sum, pay the income taxes, and ๐๐ž๐ฉ๐จ๐ฌ๐ข๐ญ ๐ญ๐ก๐ž ๐š๐Ÿ๐ญ๐ž๐ซ-๐ญ๐š๐ฑ ๐š๐ฆ๐จ๐ฎ๐ง๐ญ ๐ข๐ง๐ญ๐จ ๐š ๐ฉ๐ž๐ซ๐ฆ๐š๐ง๐ž๐ง๐ญ ๐ฅ๐ข๐Ÿ๐ž ๐ข๐ง๐ฌ๐ฎ๐ซ๐š๐ง๐œ๐ž ๐ฉ๐จ๐ฅ๐ข๐œ๐ฒ, or you can take annual payments (such as required minimum distributions) and deposit the after-tax income as annual premiums on a permanent life insurance policy.

The policy could be owned by an irrevocable trust. The trustee receives the proceeds from the policy after your death and then invests and distributes the money according to the terms you set in the trust. The ๐ข๐ง๐ฌ๐ฎ๐ซ๐š๐ง๐œ๐ž ๐ฉ๐ซ๐จ๐œ๐ž๐ž๐๐ฌ ๐š๐ซ๐ž ๐ญ๐š๐ฑ-๐Ÿ๐ซ๐ž๐ž ๐š๐ง๐ ๐ฐ๐ข๐ฅ๐ฅ ๐›๐ž ๐ซ๐ž๐œ๐ž๐ข๐ฏ๐ž๐ ๐๐ข๐ซ๐ž๐œ๐ญ๐ฅ๐ฒ ๐›๐ฒ ๐ญ๐ก๐ž ๐ก๐ž๐ข๐ซ๐ฌ ๐จ๐ซ ๐›๐ฒ ๐ญ๐ก๐ž ๐ญ๐ซ๐ฎ๐ฌ๐ญ.
