New Jersey measures its property tax assessments based on the "true value" or market value of the property, which is determined by local municipal tax assessors. Here’s how the process works:
In New Jersey, property taxes are an "ad valorem" tax, meaning they are calculated according to the value of the property. The standard for assessing this value is set by the New Jersey Constitution and statutes, specifically N.J.S.A. 54:4-23, which require real property to be assessed at its "full and fair value." This is typically interpreted as the price a willing buyer would pay a willing seller in an arms-length transaction on the open market as of October 1 of the pretax year. For most properties (except qualified farmland), this true value is meant to reflect 100% of its market value, though counties can adjust this percentage through an assessment ratio if needed.
The process begins with the local tax assessor in each municipality, who is responsible for determining the taxable value of all real property within their jurisdiction. Assessors evaluate properties annually, taking into account factors like recent sales of comparable properties, property improvements, and changes in market conditions. The assessed value is then submitted to the county board of taxation by January of each year. This data forms the basis for the tax rolls, which are used to calculate property taxes.
