Know Your Rights: Students Who Are Deaf or Hard of Hearing (DHH) in Texas
Students who are Deaf or Hard of Hearing are entitled to special supports and services under federal and state law to help them learn, communicate, and thrive in school. Here's what you need to know:
🎓 Educational & Communication Rights
Communication Access: Your child has the right to learn in their preferred communication mode (e.g., ASL, spoken English, total communication).
Direct Communication: Your child should have opportunities for direct communication with peers and teachers in the same communication mode.
Qualified Staff: Teachers and interpreters must be certified and trained to work with DHH students.
Assistive Technology: Schools must provide and support hearing aids, FM systems, and other assistive listening devices as needed.
Parental Involvement: You must be involved in all decisions and provided information in a language or mode you understand.
🧾 IEP & Evaluation
Full & Individual Evaluation (FIE): Must assess your child’s communication, language, and hearing needs.
IEP Team: Must include specialists (e.g., audiologists, DHH teachers, speech-language pathologists) who understand your child’s needs.
Goals & Services: The IEP must include specific goals and services for communication, hearing, and academic success.
Texas Rule:
Under TAC §89.1131, Texas schools must ensure that the ARD committee considers a DHH student’s language and communication needs, including opportunities for direct communication and instruction.
