We recently won another successful habeas corpus case.

Our client entered the United States without inspection and was later detained by ICE while working at a massage parlor during a workplace immigration status check.

After her arrest, she discovered that there had been a removal order issued against her three years ago because she didn’t go to her immigration hearing. It later became clear that her previous attorney had failed to notify her of the hearing date.

We first filed a motion to reopen her immigration case, which was ultimately granted.

At the same time, we filed a habeas corpus petition in federal court. The petition was more than 20 pages long and made five legal arguments challenging her continued detention.

The federal judge ordered her immediate release after 3 days. The government agencies did not oppose the order, and our client was released from detention two days later.

Cases like this are a reminder that immigration detention cases often move extremely quickly, and timely legal action can make a critical difference in a person’s life and future.
