Oregon firearm owners were just handed a long-delayed victory.
For nearly two years, clients have paid to have their rights to firearm ownership restored through Oregon's set-aside process (known often as "expungement") only to find the State was reviving set-aside charges and using them as a basis for denial.
During that time, many came to our office complaining of being delayed and/or denied when attempting to purchase a firearm. My office could never get answers directly from OSP, but a leaked memo revealed Oregon was refusing to acknowledge set-asides, despite the court order standard to each set-aside. It was a brazen rejection of a court order, but until now, they refused to follow it.
The State has now conceded in court and will once again recognize set-asides as restoring firearm rights.

This is a huge win!
The court could have found several ways in their favor, but this was the absolute best case scenario for public landowners everywhere.

This morning the Oregon Attorney General’s office asked the Oregon Supreme Court to stay (or stop) a Temporary Restraining Order issued by a Harney County judge.
The Oregon Supreme Court denied the Oregon AG’s request. As of now, the TRO is in effect and the provisions of 114 will not go into effect until the State can show cause why it should otherwise be allowed to enforce it.
As of tonight, the soonest Measure 114 will become law will be December 13. Updates to follow.
