Ohio Traffic Law Update: Per Senate Bill 288 (Ohio's criminal law omnibus bill), "distracted driving" is now a primary offense under Ohio's traffic code.

IF YOU HAVE A DRIVER'S LICENSE IN OHIO, YOU NEED TO KNOW THIS INFORMATION!

Beginning April 4, 2023, distracted driving is now a primary offense under Ohio Law (R.C. 4511.204). Under the new law, distracted driving now includes "using, holding, or physically supporting any part of the person's body an electronic wireless device."

During the six month public education period (through October 4, 2023), violators will be given written warnings. Thereafter, citations. Distracted driving is an unclassified misdemeanor in Ohio. A first offense carries 2 BMV points and a fine of up to $150. By the third offense, the Court may impose up to a $500 fine and a 90-day license suspension. The offender will also be assessed 4 BMV points.

The new statute also contains thirteen (13) emergency exceptions.
