The Statutory Duty to Hire Registered Professionals.

Both public and private sector employers, including parastatals, face severe statutory liabilities if they hire unregistered practitioners. Under the Registration of Architects, Engineers, Surveyors and Allied Professionals (AESAP) Act No. 15 of 2013, employment practices are strictly regulated to protect public safety and guarantee structural integrity.

The Statutory Framework: Joint Liability.

Parts V through VIII of the AESAP Act No. 15 of 2013 prohibit anyone from performing architectural, engineering, quantity surveying, or allied professional work without a valid registration certificate. Crucially, the law places liability on both the individual practitioner and the employing entity. If an employer engages an unregistered person, both parties are committing a serious statutory offense.

Penalties for Non-Compliance:

The AESAP Council Eswatini enforces compliance through random, unannounced site audits and firm inspections. Failing to verify professional standing carries harsh penalties:

• Fines: A penalty of up to E50,000.00 (Fifty Thousand Emalangeni) per offense.

• Imprisonment: A criminal prison sentence of up to five (5) years for responsible corporate officers or individuals.

• Project Red Flags: Immediate work stoppages and loss of investment due to structural review delays.

• Demand the Annual Practising Licence: A registration certificate alone is not enough. Professionals must hold a valid, annually renewed practising licence issued by the AESAP Council.

• Maintain Professional Fidelity: Ensure your hired professionals adhere to the statutory code of conduct, prioritizing public interest and safety over cutting corners.
