MISSED ASR PRAYER BUT CAME TO THE MOSQUE WHILE MAGHRIB WAS GOING ON

Ibn Taymiyyah r.h said:

[مَسْأَلَةٌ فَاتَتْهُ صَلَاةُ الْعَصْرِ فَجَاءَ الْمَسْجِدَ فَوَجَدَ الْمَغْرِبَ قَدْ أُقِيمَتْ]

113 - 29 مَسْأَلَةٌ:

فِي رَجُلٍ فَاتَتْهُ صَلَاةُ الْعَصْرِ: فَجَاءَ إلَى الْمَسْجِدِ فَوَجَدَ الْمَغْرِبَ قَدْ أُقِيمَتْ، فَهَلْ يُصَلِّي الْفَائِتَةَ قَبْلَ الْمَغْرِبِ أَمْ لَا؟

الْجَوَابُ: الْحَمْدُ لِلَّهِ رَبِّ الْعَالَمِينَ. بَلْ يُصَلِّي الْمَغْرِبَ مَعَ الْإِمَامِ، ثُمَّ يُصَلِّي الْعَصْرَ بِاتِّفَاقِ الْأَئِمَّةِ، وَلَكِنْ هَلْ يُعِيدُ الْمَغْرِبَ؟ فِيهِ قَوْلَانِ: أَحَدُهُمَا: يُعِيدُ، وَهُوَ قَوْلُ ابْنِ عُمَرَ، وَمَالِكٍ، وَأَبِي حَنِيفَةَ، وَأَحْمَدَ فِي الْمَشْهُورِ عَنْهُ.

وَالثَّانِي: لَا يُعِيدُ الْمَغْرِبَ، وَهُوَ قَوْلُ ابْنِ عَبَّاسٍ، وَقَوْلُ الشَّافِعِيِّ، وَالْقَوْلُ الْآخَرُ فِي مَذْهَبِ أَحْمَدَ. وَالثَّانِي أَصَحُّ، فَإِنَّ اللَّهَ لَمْ يُوجِبْ عَلَى الْعَبْدِ أَنْ يُصَلِّيَ الصَّلَاةَ مَرَّتَيْنِ، إذَا اتَّقَى اللَّهَ مَا اسْتَطَاعَ، وَاَللَّهُ أَعْلَمُ.

[مَسْأَلَةٌ دَخَلَ وَالْخَطِيبُ يَخْطُبُ وَهُوَ لَا يَسْمَعُ كَلَامَ الْخَطِيبِ]

[Issue: He Missed the Asr Prayer and Arrived at the Mosque to Find that Maghrib Had Already Been Established]

Question 113 - 29:

A man missed the Asr prayer and arrived at the mosque to find that the Maghrib prayer had already been established. Should he perform the missed prayer (Asr) before joining the Maghrib prayer, or not?

Answer:
All praise is due to Allah, the Lord of the Worlds. He should pray Maghrib with the imam and then pray the Asr prayer, according to the consensus of the leading scholars.

However, the question arises: should he repeat the Maghrib prayer afterward? There are two scholarly opinions on this:

The first opinion is that he should repeat the Maghrib prayer. This is the view of Ibn Umar, Malik, Abu Hanifa, and what is most well-known from Ahmad.

The second opinion is that he does not need to repeat the Maghrib prayer. This is the view of Ibn Abbas, the Shafi’i school of thought, and the second opinion in the Hanbali school.

The second opinion is more correct, as Allah has not made it obligatory upon a person to pray the same prayer twice if he has feared Allah and done his best to fulfill his obligations. And Allah knows best.
