The Federal Constitutional Court has struck down Section 7E of the Income Tax Ordinance, declaring it ultra vires (unconstitutional). For the real estate sector, this is a major and much-needed relief.

𝐖𝐇𝐀𝐓 𝐖𝐀𝐒 𝐒𝐄𝐂𝐓𝐈𝐎𝐍 𝟕𝐄?

Introduced through the Finance Act 2022, Section 7E imposed a tax on deemed income from immovable property. Even when a property generated no rent, the law treated it as producing income equal to 5% of its fair market value and taxed that assumed amount.

𝐀 𝐂𝐎𝐍𝐒𝐓𝐈𝐓𝐔𝐓𝐈𝐎𝐍𝐀𝐋 𝐎𝐕𝐄𝐑𝐒𝐓𝐄𝐏

The main problem was constitutional. Under Pakistan’s Constitution, the Federal Government may tax actual income, but taxation of immovable property itself falls within provincial domain. Legal experts argued that Section 7E crossed that boundary by dressing a property tax as income tax.

𝐓𝐇𝐄 𝐅𝐈𝐍𝐀𝐋 𝐕𝐄𝐑𝐃𝐈𝐂𝐓

The Federal Constitutional Court agreed.

By declaring Section 7E ultra vires, the Court confirmed that the federal government did not have lawful authority to impose this specific tax in this manner.
