Key Legal Takeaways from case – Supreme Court of Pakistan Judgment
📌 In Criminal Petition No. 467/2023 (Zahir Zakir Jaffar case), the Supreme Court upheld key legal principles:
1️⃣ Conviction on Circumstantial Evidence:
Conviction can be based solely on circumstantial evidence if the chain is unbroken and conclusively links the accused to the crime. Quality and consistency matter more than quantity.
2️⃣ Admissibility of CCTV Footage:
CCTV footage is admissible as primary evidence under the “Silent Witness” theory. No human witness is required if the footage is authenticated and verified by forensic report (per State v. Ahmed Omar Sheikh).
3️⃣ Digital Evidence as Primary Proof:
The Court reaffirmed that digital evidence is no longer hearsay. Amendments in the law now allow such evidence to be treated as primary and reliable, if acquired through trusted means.
4️⃣ Use of Technology in Trials:
Video evidence from modern devices (e.g., WhatsApp, Skype, etc.) can be lawfully used in courts (Article 164, QSO 1984, amended).
📽️ The Court treated CCTV recordings showing physical assault and other forensic evidence (DNA, weapon recovery) as sufficient to maintain conviction.
⚖️ Outcome:
Death sentence under Section 302(b) PPC maintained
Life imprisonment under Section 376 PPC (converted from death)
Acquittal from Section 364 PPC
Co-accused released due to reduced sentences
📚 Key Principle:
Digital evidence, if reliable and forensically verified, can be the sole basis of conviction in serious crimes like murder and r**e.
