Sa Senate of the Philippines, ang quorum ay yung minimum number of Senators na kailangang present para valid na makapagtrabaho at makapagdesisyon ang Senado. (Halimbawa, mag-debate, mag-boto, mag-approve ng motions o mga bills). Kung walang quorum, generally hindi puwedeng mag-transact ng “business”, except yung limited actions tuladd ng mag-adjourn or mag-compel ng attendance ng absent members (depende sa rules).

Since the Senate has 24 members, 13 Senators ang usual quorum requirement (majority).

Sa Avelino v. Cuenco (1949), issue kung may quorum ba kahit hindi kumpleto ang present na Senators. Ang doctrine na madalas i-quote: puwedeng i-consider na “quorum” ang majority ng “members who can be compelled to attend,” kaya kung may Senator na nasa labas ng bansa at beyond the coercive power of the Senate, maaaring hindi na siya isama sa bilang para sa quorum computation.

In local legislative bodies, the Supreme Court emphasized that the quorum rule is usually based on members “elected and qualified,” and claims that someone is beyond coercive power must be supported by proof; hindi puwedeng “assumption” lang.

Quorum “enough Senators present to make the Senate a lawful body that can do business.” And Avelino is the classic case reminding that quorum can hinge on who is realistically countable/compellable, especially when someone is outside coercive reach.
