LICENSE TO SELL (LS) from the Department of Human Settlements and Urban Development (DHSUD) is required for developers to legally sell subdivision lots or condominium units.
This license is issued after the developer secures a Certificate of Registration (CR) and demonstrates that the project complies with standards and that the sale won't be fraudulent.
The mere lack of license to sell is not a ground for the cancellation of the sale. However, a project without a license to sell may have violated certain standards and requirements of PD 957 which can likewise constitute a breach of the developer’s obligations to the buyer. Any buyer may report an unlicensed project to the Regional Office where the project is located for any assistance in relation to the purchase of a housing unit in an unlicensed project.
Buyers are encouraged to verify the existence of a valid LS before purchasing.

📌WHAT SHOULD A BUYER DO IN CASE THE DEVELOPER FAILS TO FULFILL ANY OF ITS OBLIGATIONS STIPULATED IN THE CONTRACT TO SELL?
The buyer may demand the developer to fulfill the latter’s obligations in accordance with the Contract to Sell or any other purchase documents providing for the terms and conditions thereof. If the developer refuses to do so, any buyer can seek assistance from the Regional Office of the DHSUD where the project is located in order to enforce the obligations of the developer. The buyer may also file a formal complaint against the developer before the Regional Adjudication Branch (RAB) of the Human Settlements Adjudication Commission (HSAC), an attached quasi-judicial agency of the DHSUD with the mandate of resolving issues relating to the implementation of the mandates of the DHSUD.
📌ARE ALL SUBDIVISION AND CONDOMINIUM PROJECTS REQUIRED TO BE LICENSED FIRST BY THE DHSUD BEFORE THE DEVELOPER CAN START ADVERTISING AND/OR SELLING LOTS, HOUSES AND UNITS?
Yes, all subdivided projects, with or without housing units, and condominium units, are required to be first registered with and licensed by the DHSUD under Presidential Decree No. 957 (PD 957), or the “Subdivision and Condominium Buyers’ Protective Decree.” The DHSUD has Regional Offices across the country where any prospective buyer may inquire whether a subdivision or condominium project is registered and licensed. 📌WHAT ARE THE ADVANTAGES AND SAFEGUARDS OF BUYING ONLY FROM REGISTERED AND LICENSED HOUSING PROJECTS OF DEVELOPERS?
The license to sell is only issued by the DHSUD to projects with approved subdivision and condominium plans complying with the required minimum standards on lot sizes, floor areas, open spaces, parks and playgrounds, street widths, and sidewalks, sewer and drainage system, among others. As the project is registered with and licensed by the DHSUD, it will be easier for the buyers to enforce their rights against the developer, and/or demand refund and even damages, if the latter fails to comply with the standards and fulfill its obligations and warranties.
